The first type of damages that can be sought in a wrongful death suit are those encountered by the victim from the time their accident occurred until the time of their death.
Those damages may include any medical expenses for emergency treatment and care the victim received, any pain or suffering their injuries caused them, and funeral and burial or cremation expenses. A reputable wrongful death attorney can review the facts of your case and tell you which damages are applicable.
The next type of damages victims can seek are those the family experienced caused by the victim’s passing. These may include financial losses, like the loss of the income and benefits the deceased would have provided if they were still alive, along with the emotional losses arising from the death.
Emotional losses include things such as mental trauma, loss of companionship, loss of guidance, and loss of care. An experienced wrongful death attorney can calculate a dollar figure for these non-economic damages.
The family member filing the lawsuit might also be able to pursue punitive damages. These are intended to punish an offender when their negligent actions were particularly reckless or egregious. Punitive damages are also used to discourage others from acting the same way. Not all cases merit punitive damages. A knowledgeable wrongful death attorney can correctly gauge if they apply to your case.
