Hurricane, UT (September 30, 2022) – A 15-year-old boy from LaVerkin was killed on Thursday, September 29th after he was hit by a truck in Hurricane.
At about 7:35 p.m., Hurricane Police officers responded to a collision between a truck and a bicycle in the area of 400 West and 400 South.
According to sources, a 56-year-old man from Santa Clara was driving a 2021 Dodge Ram 2500 pickup truck eastbound along 400 South when he struck a 15-year-old boy riding an electric bicycle northbound on 400 West. After the impact, the child and his bike were caught underneath the truck, resulting in severe injuries.
Upon their arrival, officers took over life-saving measures from a nurse who witnessed the accident. Those measures were then continued when EMTs arrived.
The boy was unable to be resuscitated and succumbed to his injuries at the scene.
We would like to offer our deepest condolences to the family of the deceased victim at this time.
Those who are entitled to benefit from a wrongful death claim are clearly outlined under Utah law. Those who were close to the deceased, or who were financially dependent on the deceased, are the only ones who can bring this kind of claim. In many cases, those who pursue financial compensation following a wrongful death are immediate surviving family members, such as a child or a spouse. Financial dependents and extended family members may, however, have a valid case if the deceased had no immediate family.
Immediate Family Members
Spouses, children, adopted children, life partners, and any other dependents are entitled to file a lawsuit against the person or persons responsible for the wrongful death of their family member. In these cases, the immediate family usually takes precedence, meaning if any other family members, like parents or siblings, try to file for wrongful death, immediate family members will be regarded first.
Financial Dependents
A person who was financially dependent on the deceased is entitled to pursue financial compensation. Since the deceased was supplying and, presumably, planned to continue to supply economic resources to their dependent, that dependent should continue to obtain the financial help they were offered. Even though immediate family members will take priority, all dependents are eligible to seek compensation.
Extended Family
In the event that the deceased has no immediate family members or financial dependents, then extended family members might be able to sue for wrongful death. Extended family members include blood relatives who will act as the victim’s heir. Adult children, spouses, parents, and other dependents could fall under the umbrella of extended family.
