Anyone walking through a developed area or by the side of a roadway is considered a pedestrian. Pedestrians are, basically, anybody traveling by foot, even if they are doing nothing more than walking across a parking lot. There are both state and local laws that govern how and when pedestrians may use Utah’s roadways that are intended to keep them safe a prevent terrible accidents.
Even though intersections are generally considered an area for pedestrian and vehicular use, not every intersection has properly designated crosswalks. All intersections are appropriate spots for a pedestrian attempting to cross the street with the exception of those that have higher speed limits or are exceptionally busy. In areas that are more metropolitan, intersections known to be busy are usually provisioned with some sort of bridge or skyway.
Anytime a pedestrian is inside a crosswalk, drivers have a duty to yield the right of way. Given the vast difference between the sizes and weights of motor vehicles and pedestrians, it is compulsory for drivers to yield to those on foot under almost any circumstances.
Due to the dramatic increase in Utah’s distracted driving demographic, a lot of drivers neglect to even notice pedestrians or show any concern for their safety. In their haste to get to their dentist appointment, squeeze through a stoplight, or beat rush hour traffic, drivers commonly fly through crosswalks, putting Utah’s most vulnerable roadway users, pedestrians, in grave danger. Pedestrians involved in motor vehicle crashes normally endure catastrophic injuries that have dire, and sometimes even permanent, ramifications.
Pedestrians do not come equipped with safety features nor do they have the security of a metal frame to protect them from any impact. As a result, their injuries generally result in severe financial, physical, and psychological repercussions. Sadly, the insurance companies and the negligent driver will not want to settle by fairly compensating you for your injuries and damages. They will do anything to lowball or devalue your claim, and leave you without the reimbursement you so desperately need.
