There are multiple situations that could result in wrongful death, including circumstances where your family member was involved in a fatal motor vehicle crash, was the victim of medical malpractice, was intentionally killed, or any of the numerous events that could result from another’s negligence or malice.
The most common types of Utah wrongful deaths include:
- Injuries and accidents: When an accident occurs due to the negligent or reckless actions of another person, a motorist, badly maintained roads, a defective car part, job site accidents, and many other circumstances, catastrophic injuries can and do occur. If that negligent behavior played a role in the death of another, a survival claim and wrongful death claim can both be brought.
- Defective and dangerous products: Manufacturers are trusted to make sure their products are safe for consumers to use. When this responsibility is violated because they failed to warn against, identify, or report a flaw or defect in their product or a danger intrinsic in its use, a liability suit may be filed. If a consumer dies due to using a product with defects or dangers that a manufacturer failed to alert them to, a wrongful death claim may be filed.
- Defective or dangerous drugs: When a company that makes pharmaceutical drugs neglects to supply sufficient warnings to the Federal Drug Administration and its customers about the detrimental effects of their medication, they are liable for any injuries resulting from that drug’s use. In the event a patient dies due to taking a dangerous or defective medication, a wrongful death lawyer will be able to help you file a suit against the drug manufacturer.
- Medical malpractice: Medical malpractice has taken place if the negligence of a hospital, doctor, surgeon, nurse, or other health care provider or entity has brought about a patient’s death. Common examples involve inaccurate dosages of medication, surgical mistakes, delayed treatment, or misdiagnoses. When a patient loses their life because of medical negligence, specific surviving family members could be eligible to file a claim of wrongful death.
