Before turning to the other person’s insurance company for assistance with medical expenses and lost earnings, victims must first file a claim against their own personal injury protection policy. However, where property damages are concerned, they can file a claim against the negligent driver’s insurance immediately.
Utah is a no-fault state, so victims are entitled to file a claim against the other motorist’s insurance in the event that they have:
- Medical bills of $3,000 or more
- A major injury
- Been found responsible for no more than 49% of the accident
The elaborate rules that oversee insurance claims in Utah can be hard to understand, particularly when you have just been unnerved by a serious accident. Our experienced Utah personal injury lawyers are ready to help you know your rights and understand your options.
