Any person on foot in a developed area or by the roadside is viewed as a pedestrian. Even if all someone is doing is walking across a parking lot, a pedestrian is basically anyone on foot. There are state and local laws that oversee exactly how and when pedestrians are able to use the state’s roadways. These are designed to keep pedestrians safe a prevent tragic accidents.
While intersections are normally considered an area to be used by both pedestrians and motor vehicles, some intersections do not have adequate crosswalks. With the exception of those that are extremely busy and those with higher speed limits, all intersections are intended to be suitable spots for a pedestrian trying to cross the street. In areas that are more developed, such as large cities, known busy intersections are often outfitted with some sort of bridge or walkway.
Anytime a pedestrian is inside a crosswalk, drivers have a duty to yield the right of way.
Pedestrians do not have the protection of a metal frame to cushion them from any impact, nor do they come with safety features. With this in mind, their injuries often bring about serious mental, physical, and financial repercussions. Sadly, the insurance companies and the negligent driver will not want to settle by fairly compensating you for your injuries and damages. They will do anything to lowball or devalue your claim, and leave you without the reimbursement you so desperately need.
When you hire a victim injury attorney to represent you following a pedestrian crash, your chances of obtaining full recovery for your losses greatly improve. A practiced attorney can tell you if your claim is being dealt with fairly.. With their decades of legal experience on your side, you can feel confident that evidence is being gathered in your favor and a persuasive legal strategy designed to help you meet your goals is being crafted.
