Pedestrian Fatalities in Utah
After losing a loved one in an accident, your whole life changes. Along with losing someone you love, you have also just lost the emotional support of a spouse, child, or parent. Even though we always carry those we love with us, it is important to keep justice and your family’s future in mind.
If your relative died by misadventure or an accident that wasn’t their fault, you could be entitled to file a claim of wrongful death. Third-party liability is an important factor in wrongful death cases. The surest way to determine if you are eligible to file is to ask yourself if the deceased would have been able to file a personal injury suit had they survived, and, if so, against whom would they have filed it.
In Utah, a wrongful death claim can be filed by the representative of the deceased’s estate or by the deceased’s beneficiaries. Often, these people are one and the same but, occasionally, the estate’s representative is not a blood relation. In addition to this, family members who are not technically blood-related, such as adoptive parents or stepchildren, are also entitled to file a claim.
If you are uncertain who is responsible for your loss, our attorneys can conduct a thorough investigation of the accident.
