Thanks to the exponential rise in the number of distracted drivers on Utah’s roadways, many motorists fail to notice pedestrians or give any consideration to their safety. In their hurry to get to an appointment or make it through a stoplight, drivers frequently fly through crosswalks, putting the roadway’s most vulnerable users, pedestrians, in danger. Pedestrians involved in vehicle accidents often sustain catastrophic injuries that have disastrous, and sometimes permanent, outcomes.
A pedestrian is anyone who walks in a developed area or alongside a roadway. They are, essentially, anyone traveling on foot, even if they are simply crossing a parking lot. Local and state laws govern how and when pedestrians use the roadways and are designed to help keep them safe.
Pedestrians do not have safety features or the weight of a metal frame to shield them from the impact. The ensuing injuries often result in serious physical, financial, and emotional repercussions. Sadly, the insurance carriers and the person responsible will not want to pay you fair compensation. They will stop at nothing to undervalue or dismiss your claim, leaving you without the restitution you so badly need.
Although any intersection is considered a pedestrian area, not all intersections have marked crosswalks. Any intersection is an appropriate place for a pedestrian to cross unless the road has a high-speed limit or is busy. In more urban areas, commonly busy intersections are often outfitted with skyways or bridges.
When a pedestrian is in a crosswalk, vehicles are required to yield the right of way. Considering the enormous difference between the size and weight of a motor vehicle and the size and weight of a pedestrian, vehicles are expected to yield in almost all circumstances.
