Cedar City, UT (June 26, 2022) – Two drivers were injured and both were cited after a two-vehicle crash on a residential street on Wednesday, June 29th in Cedar City.
The incident took place at about 10:15 a.m. on 700 West about mid-block between 500 South and 400 South when a Ford Focus and a Subaru Impreza collided.
An officer from the Cedar City Police Department said that the driver of the Subaru was traveling northbound on 700 West as the driver of the Ford was pulling out of a driveway. The Ford’s driver did not see the Subaru and struck the vehicle’s front end as it exited the private driveway.
The driver of the Subaru, an adult male, sustained unspecified non-critical injuries. He was taken to an area hospital for medical treatment.
The driver of the Ford, an adult female, also received non-critical injuries, including abrasions caused by the deployed airbags.
The drivers were the sole occupants of their vehicles.
The driver of the Ford was cited for failure to yield. The Subaru was cited for speeding.
Both cars took heavy front-end damage and had to be towed from the scene.
No two accidents are quite the same. This means it can be hard to determine if victims are entitled to compensation without the benefit of a licensed attorney.
Calculating the value of your accident claim is extremely difficult without the guidance of an experienced attorney. The lawyers at Jardine Law Offices P.C. have a comprehensive understanding of all local and state laws and decades of experience handling these kinds of cases.
Some forms of compensation crash victims may be entitled to include:
- Prescription drug expenses
- Medical equipment/Medical supplies
- Pain/Suffering
- Emotional trauma
- Psychological problems
- Lost earnings
- Reduced earning capacity
- Vehicle repairs or replacement
- Damage to property
- Modifications to your vehicle or home to accommodate your disability
- Funeral expenses/Burial or cremation expenses
- Other medical costs
Before compensation can be calculated, however, you must show that you have a valid claim by proving that the four elements of negligence were present.
- Was a duty of care owed?: Did the liable party have a statutory obligation to act in a reasonable manner to prevent harm from coming to themselves and others?
- Was that duty breached?: When someone violates their duty of care, people can easily get hurt. Would a prudent person in the same or a similar situation have behaved differently to prevent harm? If so, the duty of care may have been violated.
- Does causation exist?: You or your lawyer will have to show that your injury was directly caused by the violated duty of care. Could the accident have been prevented if the defendant had maintained their duty?
- Were damages generated?: Did the accident result in economic damages like medical expenses, lost income due to being unable to work, or property damage? In some cases, victims might be eligible to collect compensation for emotional trauma.
