America is home to more than 600 railroad systems that run over hundreds of thousands of miles of train tracks and criss-cross over 209,000 railway crossings. Every year, an estimated 1,000 vehicle occupants, pedestrians, and cyclists die in accidents involving trains and about 50% of those deadly incidents occur at railroad crossings that are completely unmarked.
These types of negligent acts usually have disastrous repercussions for the passengers and/or crew who are riding or working on the train as well as others in the area.
The sudden increase in train accidents across the United States in the past few years has caused the millions of passengers who depend on subways, freight trains, metros, commuter rails, passenger trains, elevated trains, and other forms of trains to get to and from work or for their daily errands to become increasingly worried about their safety.
Train accidents are most often the result of common negligence on the part of a railroad company, due to things such as declining track conditions that are left unattended for too long, equipment or tools sitting on the tracks, moving at unsafe speeds around sharp corners, or engineers who are distracted or fatigued while they are in charge of driving the train.
According to Utah law, if you were injured as the result of another party’s negligence or maliciousness, you are likely entitled to pursue financial recovery by way of a personal injury claim.
