Deaths on Private Property in Utah
Private property owners are required to ensure the safety of all guests on their property.
On private property, visitors are put into one of three classes: invitees (visitors there for the benefit of the owner), licensees (visitors there for their own benefit), and trespassers (persons on the property illegally). Property owners or occupiers are liable to licensees, invitees, and to a lesser degree, trespassers, specifically children.
If you were injured in an accident at a privately-owned pool or a loved one drowned, it is crucial to establish what, if any, responsibility of care you were owed by the owner. After duty has been established, a Utah personal injury attorney will be able to counsel you on the best way to proceed with a premises liability claim.
These kinds of claims have to have at least one of the three elements listed below.
- The owner or occupier of the property knew of the danger and failed to inform guests or fix the problem
- The owner or occupier of the property is the same person who caused the danger
- The owner or occupier of the property was unaware of the potential risk but could reasonably have been expected to know if they were diligent about their guest’s safety
The more of these elements your claim has, the stronger it will be.
