Wrongful Deaths in Kaysville
When you lose a family member in an accident, it changes your entire life. In addition to losing someone you love, you may have just lost the financial support of your family’s breadwinner, and the emotional support of a child, parent, or spouse. While those we love never truly leave us, you must also think of your family’s security and find a way to move forward.
If your family member died by a misadventure or accident caused by someone else, you might be entitled to file a claim of wrongful death. Third-party liability is a crucial element in wrongful death cases. A reliable way to determine if you are eligible to file is to ask yourself if your family member would have been eligible to file a personal injury suit if they survived, and, if so, who would they have filed it against.
If you are unsure who is responsible for the death, our attorneys can conduct a thorough investigation of the accident.
In Utah, a wrongful death claim can be filed by the deceased’s heirs or by the representative of the deceased’s estate. Usually, these people are one and the same but occasionally, the estate’s representative is not a blood relation. In addition to this, family members who are not technically blood-related, like stepchildren or adoptive parents, are also entitled to file a claim.
