Pedestrian Fatalities in Utah
Filing a claim of personal injury as an injured pedestrian is about more than just getting money. It is also about getting justice for a driver’s negligence.
Utah law says that motor vehicles are required to yield the right of way to pedestrians. If you have been injured in an auto-pedestrian accident, you must obtain medical treatment even if you think your injuries are minor. For the benefit of not only your health but the validity of your claim as well, don’t delay seeing a doctor or going to the emergency room.
After you obtain medical attention for your pedestrian injuries, you need to be sure that you understand all of your legal options. In many instances, your claim is filed against the driver of the car that struck you, but you can also bring a claim of personal injury against the city where the accident occurred if it involved a defective stoplight or a dangerous roadway.
While Utah’s traffic and negligence laws provide legal protections to pedestrians, even if they are partially at fault, numerous legal snares can hurt your case. For example, if the driver alleges that you were jaywalking, you could lose your case against them.
Since Utah is a no-fault state, your hospital bills are paid through your insurance company up to the limit on your policy. If you, as the victim, file a lawsuit against the liable party, the losses associated with your claim. like medical bills, will be refunded to the insurer if you win.
Pitfalls like this are why you must work with a dependable attorney who can ensure that your case cannot be refuted by the opposing party.
