Salt Lake City, UT (July 06, 2021) – An 80-year-old woman was dead when police found her face down in the pool at an apartment complex in Salt Lake City.
The incident occurred on Tuesday, July 6th at the Terraces of Rose Park apartments in the area of Oakley Street and 600 North.
An official with the Salt Lake City Police Department said officers responded to the scene at about 5:00 p.m. after reports of a body being found in the water.
The woman had been in the pool for nearly two hours before someone found her. She was already dead when first responders arrived.
Her identity has not been released.
We would like to offer our deepest condolences to the family of the deceased victim at this time.
Apartment complexes are considered private property and are therefore obligated to keep lawful visitors safe. Any persons on the property will come under one of three categories:
- Invitees (paying guests)
- Licensees (social guests)
- Trespassers (persons not legally allowed to be on the property)
Tenants holding a viable lease and their guests are invitees. They are permitted to enjoy the pool in accordance with the rules and entitled to the highest possible degree of care. If you were hurt in an accident at an apartment swimming pool or a member of your family drowned, you need to find out what, if any, duty of care you were owed by the property manager. Once that has been determined, you will be able to move forward with a premises liability claim.
To be recognized by the courts, a premises liability claim must have one or more of the following three elements. The more elements you can prove, the stronger your claim will be.
- The owner or manager of the apartment complex knew of the danger and neglected to notify tenants or resolve the issue
- The owner or manager of the apartment complex is also the person liable for the danger
- The owner or manager of the apartment complex was oblivious to the potential hazard but reasonably would have been aware if she or he had been more conscientious about their tenant’s safety.
