The estate of a negligent driver may be sued for damages sustained by another person that was caused by the decedent’s actions before they died. When a person dies, their assets and debts will become part of a legal procedure known as probate. Everything owned by the decedent is inventoried and assessed and any debts the estate owes will be settled before any assets can be given to the beneficiaries or heirs of the estate. As a Utah personal injury victim, you are seen as a potential creditor with a debt owed by the decedent’s estate.
