Pedestrian Fatalities in Utah
When you lose a loved one in an accident, your entire life changes. Not only have you lost a person you love, but you may also have just lost the financial support of your family’s provider, and the emotional support of a spouse, child, or parent. Although we always carry those we love with us, it is also important to keep justice and your family’s future in mind.
If your family member died by misadventure or an accident that was someone else’s fault, you might be entitled to file a claim of wrongful death. Third-party liability is a critical element in wrongful death cases. A safe way to determine if you are eligible to file is to ask yourself if your family member would have been eligible to file a personal injury suit if they lived, and, if so, who would they have filed it against.
In Utah, a wrongful death claim can be filed by the deceased’s beneficiaries or by the representative of the deceased’s estate. Usually, these people are one and the same but, from time to time, the estate’s representative is not a blood relation. In addition to this, family members who are not technically blood-related, like stepchildren or adoptive parents, are also entitled to file a claim.
If you are unsure who is responsible for the death, our attorneys can conduct a thorough investigation of the accident.
